These Terms of Use (“Terms”) govern your access to and use of the ELVARYXA Journal – India Edition at https://blog.elvaryxa.in/ (the “Journal”). The Journal is operated by ELVARYXA from India.
By accessing or using the Journal, you agree to these Terms. If you do not agree, please do not use the Journal. These Terms apply only to blog.elvaryxa.in; other ELVARYXA websites, products or services may have separate terms.
1. About the Journal
The Journal publishes educational and editorial content about technology, artificial intelligence, websites, digital products, business, commerce, books, learning, media, design and related subjects. It may also describe ELVARYXA projects, original characters, planned ventures and development roadmaps.
A roadmap, concept, “coming soon” notice or description of a planned venture is informational only. It is not an offer, guarantee, investment opportunity, promise of launch or representation that a product or service is currently available.
2. Eligibility and responsible use
You may use the Journal only in compliance with these Terms and applicable law. If you are not legally able to agree to these Terms in your jurisdiction, you may use the Journal only with the involvement and permission of a parent, guardian or other legally authorised person.
The Journal may discuss children’s books or learning projects, but it is intended for general readers, parents, educators, creators and businesses. It is not designed as an account-based service for children.
3. Permitted use
You may access and read publicly available Journal content for lawful personal, educational or internal business reference. You may share an ordinary link to a public page and quote limited portions where permitted by applicable law, provided that you accurately credit ELVARYXA, do not alter the meaning and do not suggest endorsement.
4. Prohibited conduct
You must not:
- use the Journal for unlawful, fraudulent, deceptive, abusive or harmful activity;
- attempt to gain unauthorised access to the website, hosting environment, administration area, accounts, systems or data;
- introduce malware, malicious code, automated attacks, excessive requests or any activity that disrupts or degrades the Journal;
- impersonate ELVARYXA or another person, misrepresent an affiliation, or use ELVARYXA branding in a misleading manner;
- copy, republish, sell, license or commercially exploit substantial Journal content without prior written permission;
- systematically scrape, harvest, mirror, frame, text-and-data mine, or use Journal content to train or develop an artificial-intelligence or machine-learning system without prior written permission, except to the extent such restriction cannot lawfully apply; or
- remove copyright, trademark, attribution or other proprietary notices.
5. Intellectual property
Unless otherwise stated, the Journal’s original articles, written material, page design, graphics, illustrations, videos, brand stories, project names, original characters and other original content are owned by or licensed to ELVARYXA and are protected by applicable intellectual-property laws.
The ELVARYXA name, wordmark, logo, tagline, visual identity and related brand assets are proprietary brand identifiers. No licence to use them is granted except for ordinary factual reference or with prior written permission. Third-party names, logos, products and content remain the property of their respective owners.
6. Editorial and informational content
Journal content is provided for general information and education. Although we aim to publish useful and carefully prepared material, information may be incomplete, become outdated or contain errors. You should independently verify information before relying on it.
Nothing on the Journal is legal, financial, investment, medical, tax or other regulated professional advice. Examples, estimates, comparisons, forecasts, earnings figures and business ideas are illustrative and do not guarantee any result. Decisions and outcomes depend on your circumstances, skills, costs, market conditions and compliance obligations.
7. Editorial independence and corrections
We may edit, update, correct, expand or remove Journal content when appropriate. Publication dates and “last updated” dates may be displayed where relevant. Our editorial standards and correction process are described on the Editorial Policy, Review Methodology and Corrections pages.
8. External links and third-party services
The Journal may link to independent websites, tools, platforms, products or services for reference or convenience. ELVARYXA does not control those third parties and does not guarantee their availability, accuracy, safety, legality, pricing, policies or performance.
Your use of a third-party website or service is governed by that provider’s own terms and policies. You are responsible for reviewing them and evaluating a product or service before downloading, purchasing, registering or sharing information.
9. Advertising, sponsorships and affiliate links
The Journal does not currently present every referenced product or link as an endorsement. If content contains advertising, sponsorship, a complimentary product, an affiliate link or another material commercial relationship, we will aim to disclose that relationship clearly where appropriate.
If you purchase from an independent third party after following a link, your transaction is with that third party, not with the Journal, unless the page expressly states otherwise. Prices, availability and terms may change without notice.
10. Communications, corrections and feedback
The Journal currently provides a direct email contact channel rather than public user accounts or a public submission platform. If you send a message, correction request, suggestion or feedback, you confirm that you have the right to provide it and that it does not contain unlawful material or infringe another person’s rights.
Do not send confidential documents, trade secrets, passwords, financial credentials, sensitive personal information or unsolicited commercial material unless an appropriate process has first been agreed with us. We may use non-confidential feedback to review and improve the Journal without an obligation to compensate you, unless we agree otherwise in writing.
11. Privacy and cookies
Our handling of personal information is described in the Privacy Policy. Our use of cookies and similar technologies is described in the Cookie Policy. Those policies form part of the website information you should review when using the Journal.
12. Website availability and security
We may maintain, update, suspend, restrict or discontinue any part of the Journal at any time. We do not guarantee uninterrupted access, compatibility with every device, permanent availability of any page, or that the website will always be free from errors, harmful components or security incidents.
You are responsible for using appropriate device security, maintaining backups and deciding whether a download, external link or third-party service is suitable for you.
13. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Journal and its content are provided on an “as is” and “as available” basis. ELVARYXA makes no express or implied warranty that the content is complete, current, error-free, suitable for a particular purpose or capable of producing a particular business, financial, educational or personal result.
14. Limitation of liability
To the fullest extent permitted by applicable law, ELVARYXA will not be liable for indirect, incidental, special, consequential or similar loss arising from your access to, inability to access, use of or reliance on the Journal, its content or an independent third-party website or service.
Nothing in these Terms excludes or limits liability, rights or remedies that cannot lawfully be excluded or limited, including any mandatory consumer rights that apply to you.
15. Future products, services and subscriptions
The Journal does not currently operate a checkout, paid subscription or product-ordering service. If ELVARYXA later offers products, digital downloads, subscriptions, software, bookings or other paid services, separately reviewed purchasing, pricing, delivery, renewal, cancellation, refund, support and licensing terms may apply.
Those specific terms will apply to the relevant transaction and will prevail over these general Terms if there is a direct conflict. Nothing in future transaction terms will remove rights that applicable law does not permit a business to exclude.
16. Restriction of access
We may restrict or block access where reasonably necessary to protect the Journal, users, systems, content or legal rights; respond to misuse or a security threat; enforce these Terms; or comply with law. Provisions that by their nature should continue—including intellectual-property, disclaimer, liability and governing-law provisions—will survive such restriction.
17. Changes to these Terms
We may revise these Terms when the Journal, our activities or applicable requirements change. The revised Terms will be posted on this page with an updated date. Your continued use of the Journal after revised Terms take effect means that the revised Terms will govern your subsequent use.
18. Governing law and disputes
These Terms are governed by the laws of India, without prejudice to any mandatory rights or protections that apply under the law of your place of residence. Courts or tribunals having jurisdiction under applicable Indian law may hear disputes relating to these Terms or the Journal.
Before starting formal proceedings, you are encouraged to contact us so that we can try to understand and resolve the issue informally. This does not prevent either party from seeking urgent relief or using a statutory complaint or consumer-redress process.
19. General provisions
If a provision of these Terms is found unlawful or unenforceable, it will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply. A failure to enforce a provision immediately does not waive the right to enforce it later. These Terms do not create a partnership, agency, employment or joint-venture relationship between you and ELVARYXA.
